Every time you think about not going after them with a lawyer, think about the fact that this could have killed you.

But I'm also not a very empathetic person to begin with when dealing with stuff like this.

The courts do not award money for "could haves". The courts purpose is to make a person with a loss whole again.

if you had a yard the size of a postage stamp this wouldn't be an issue

 

i wonder if the huddle has any experts on how to buy houses with yards the size of postage stamps

I have family in LA and you Alice, continuously make me worry about their future. Because based on your reading comprehension, it is not one becoming of your age and supposed education.

It actually wasn't mean as an insult to you. The idea of courts making you more than whole based on "could haves" is one of the most popular legal misconceptions.

Punitive damages say HELLO.

Because they are usually paid in excess of the plaintiff's provable injuries, punitive damages are awarded only in special cases, usually under tort law, where the defendant's conduct was egregiously insidious. Not what happened, gross negligence, maybe at most.

I could POSSIZBLY see a judge awarding punitive damages under the "making an example" criteria....person partying and shooting off a flare fun in a neighborhood....catching a house of fire.

 

Not saying that he will get it, but a possibility.

I think the fact the guy stayed around and was actively trying to put it out would rule out the egregious insidious standard, although any judge can award anything. Just trying to give the guy here sound advice and the son that did it doesn't own the house and is an adult and you don't want to scare off the parents insurance company since they have money and son probably doesn't. What if the investigation finds one of the friends shot the gun or find a few of them shot it and don't know which shot caused the fire and finds multiple people at fault. That could get pretty messy.

His parents got home later that day but they been avoiding me.  Fire Marshall said that their home insurance will pay for my damages but when I got police report today, it called me a victim and said criminal investigation still ongoing...  Means I can't call their insurance and my house is damaged... wtf should I do?  I don't want to submit a claim through my insurance... I have a deductible plus my insurance will go up.  What's my options?  Lawyer up?

 

I might actually start with your insurance company. You don't have to call the other insurance company, that will be one of the duties of your insurance company. I THINK They will pay you for your damages and then they will subrogate against the other homeowners insurance company to get the money back. So your rates shouldn't go up. I THINK your insurance company will have decent lawyers who can handle much of this as well.

 

My experience is more from Auto but I think some of it is very similar

Nah 0% chance of punitive damages. Just doesn't come into play in this sort of case.
