Property Value Problem

From personal experience of having to deal with a colossal asshole in something similar to this, we started with a certified letter demanding he remedy the problem. I know this guy won't accept service, but that cute little green card will come in handy. Also, if you contact building department, zoning officials, etc, when/if you get an attorney involved, it will show you have taken steps outside of legal action and judges tend to like that. More than likely neither of these will work, but having shown that you made the effort should go a long way when it comes to legal action.

There is always the option to contact your other neighbors and have them file a suit with you against the guy for infringing on your right to peaceful and quiet enjoyment of your home. If you do it in small claims and have 10 of your neighbors bring suit with you, could possibly hit the guy for 50k. Guessing he probably doesn't have that kind of cash and it may force him to sell to cover costs. Just a thought.

Get awarded over $50k in damages for a quiet enjoyment case, that just isn't going to happen. I e personally been through cases like these and it doesn't work that way,

The issue of what he is putting on his land can become even trickier since you mentioned he is using RVs. RVS are seen as "movables" under the law and subject to different laws than "real" property. These things are risks that can happen when you land is not part of a separate community association that would have stricter guidelines than just the counties zoning laws.

You basically mention two issue, structures in his property and disorderly disturbances. The disturbances part, if repeated arrests are made, you could possible have a case for lack of quiet enjoyment, but there is rarely a financial award given, it usually results in stay away orders and warnings, but if it continues, could result in the person not being able to live at property because the property is closer than the distance in stay away order.

Now for structures, unless the structures are on your property line or within 2-3ft, you almost have no direct recourse towards him. The courts rarely deal in claims of reduced property value of this kind. The usually recourse is that any structure not permitted by local zoning laws will be given a time period to be removed and a fee will be charged by county if the deadline is not met. Also, they could look into if the guy obtained proper permits before building the structures, and could make him pay a fine if not, and bring structures up to current code. The biggest issue is this seems to be a semi rural area and the further away you get from cities, the more lax the zoning laws. Bottom line, there is an old saying, good fences make good neighbors and your best option may be to get some very large bushes or trees to plant at your property line that would completely hide his properties view from yours. This is what trump did to the guy that held out in Scotland where he built his new golf course. If you look up that story, a lot of the same exact issues were at play.

Looking at the map again, comparing the lot sizes across the street on bottom boundary , itlooks like you could make some money subdividing the lot up into multiple lots, at least 3 on bottom half, and sell it off piece by piece. Depending on your resources and current market, you could even build houses on the new lots and sell them off. It's basic RE development and you already have houses across the street on same size lots, so there is an established market for lots that size.

I guess it depends on where you live as to how strict they are. My wife and I actually did what I had said earlier, and because all of us filed in small claims for 5k each, we were able to hit the guy really hard. He had several wandering dogs, non permitted buildings and was causing a traffic nuisance by parking all over the place blocking emergency access. It had gone on for about 18 months and we had a ton of documentation (videos, pictures, letters, etc.) We won.  He ended up having to clean up his property, then had to move and declare bankruptcy. All we were really out was court costs of $60 bucks or so each.

Last time I went out there I had to clean up all his trash. Just went out and counted at least 7-8 beer cans, a juice box, all kinds of mcdonalds bags and a bottle of wine.

you need to seriously grow a pair and tell the guy  to get his poo off your place or youll take his redneck ass to court.

 

and call the county health department and tell them his place is causing a rat infestation- which it probably is, and tell them you think they have been using illegal waste management systems - you know like shitting in the grass and outhouses- that is a public health problem and if nothing else he will get hassled.

 

And post your property line and get some security cameras for your place - I use game cams on my place that use dark infrared tech and you cant see them " flash" at night.  once he catches wind of you ratting him out, hes going to be pissed and try for some redneck payback.  Youll want pictures of him illegally trespassing on your land.

Didn't read responses closely. But, it looks like your entrance my be near his line. I was going to say put up a fence to block yourself off from him. If you can't, can you put in a new driveway? Anyway, fence him off and sell your property.

 

Of course, get the lawyer but you know that's going to be a long, long process. You may be best just doing the fence and selling.
