Arsen, didnt you just put up a fence?

 

I've stated before that no I would not personally own a pit bull, but if you have one and he's in a fence, pit bulls don't jump fences so I wouldnt have a problem with the breed if that were the case with the owner. 

 

 

Kinda silly if you ask me but when do HOA's ever think things through logically.

I would pursuit legal actions but HOA agreement had a little clause where it says all legal costs will be passed down to residents. I would have many pissed off neighbors on my hands.. Legal action is not an option,

 

I would question the legality of that especially in cases where the HoA doesn't win the case.

 

If you can afford it I would really talk to a lawyer and see what your options are. He may be able to send a letter that makes them backoff.

 

I sure as crap wouldn't give up the puppy until you really have to

They don't care about fences. It seems like if enough people complain they will take action. They protected themselves with that legal clause where all legal cost trickle down to residents... It's like people think pit bulls are demons or something...

beautiful pup you have there..  I would take her off your hands in a second but I'm not sure my current circumstances will allow it.  kills me to say that because in another 6 months I may be looking to adopt one.  great breed around kids too.

Doesn't say what penalties just saying that they will seek legal action and residents will be liable. So it's in the best interest to solve problems without getting layers involved.

 

It should explain clearly what the penalty is...and if it doesn't, that's their fault for having a shitty attorney draft the bylaws/covenants. What "legal action" would they take? If it spelled out a penalty - let's say a fine - and you failed to comply by failing to pay the fine, they could take legal action to recover that fine by actually applying it to your mortgage. I guess I don't understand what "legal action" they can take...

 

That being said, I would tell them that you are going to take as much time as necessary to find your companion a reasonable home - that you will NOT take them to a shelter. The burden is on them to explain clearly what the penalty is for non-compliance. I understand that you don't want to start a fight with the HOA or piss off your neighbors, and that's awesome. You're a good human being. Hopefully they will give you the time necessary to find your little buddy a proper new home.
