i don't know...but apparently it wasn't anything serious because they released him soon after and he went to be processed.

If he was the passenger, they couldn't have probable cause to do a breathalyzer or draw blood. The passenger can't be charged with DUI, only the driver. That said, maybe the cops aren't sure about who was driving and are covering the possibility they switched seat?. Who knows...

If you own the car and let an intoxicated person drive it and you are a passenger then you receive the same fate as the driver.....at least in NC.
