I most likely would do better if I went through the courts but I honestly just want to cut my loses, move on, and start to rebuild what I have lost.

I know you say this, and I'm not trying to be insensitive, but you're going to really really really really regret making this decision.

I've seen this happen, almost to a T.

My mom wanted out of her relationship with her ex-husband (not my father, this was her second marriage) so badly that she took on all the debt - which included two cars, 15grand in CC debt, and the house. As well as agreeing to pay almost 3000 a month in child support (about a 1/3 her monthly take) until both kids graduated HS. She's also fitting the bill entirely for their college tuition.

Having done this for 5 years, and the youngest being a senior in HS and graduating this year, she realizes that she royally fuged herself and should have just bit the bullet and brought it to court.
