It's false advertising. It's only capable of HSPA +, but they put a 4g symbol there to make it seem more appealing. HSPA+ caps out at 14.4 mbp/s, while true 4g can range from 24-43 mbp/s.

Samsung did this with a few of their phones until they got complaints of misrepresentation. Apple seems to be able to escape scrutiny on a consistent basis, which would be why they continually market sub-par tech as top of the line tech, and people just eat it up.
