Do any of you know a really bad lawyer who works cheap?

Damn, 3 year old in the car with him.

Fugger has 2 choices if I'm his wife.

AA and sobriety or divorce court.

Deac, did the poor kid get taken into protective custody or did the cops allow someone to come get him?

Well, he was passed out, so at first the police that found him thought he was sick. The kid rode in the ambulance with him to the hospital. The police called my sister while the ambulance was enroute, so she was able to meet them at the hospital. She called me, and I came and got the kid while my sister waited with her husband. Didn't find out till a little bit later that he passed out because he was drunk. I guess the hospital administered a blood test, because a little later the nurse came in and started chewing him out and reported him to Social Services and the police.

All the kid said was "Uncle, I got to ride in an ambulance today". He was pretty excited about that. :)

FYI, he is going to go the public defender route. I just hope he doesn't luck up and get one that is actually competent.

I feel you man, my brother has been arrested 11 times in 2 years after his divorce he hasnt been the same. He has court this week on a felony charge of habitual offender. His lawyer wanted 10k upfront. He has 3 DUI's 1 DUS and several assault charges from him wanting to be a MMA fighter he goes to bars looking for fights..he is a douche bag but I love his dumb ass.

No real jail time on a 1st offense (maybe a weekend), with a BAC that high...will loose his license for a year...no chance of getting a restricted one. I think.

But, are they adding on a charge for child abuse or neglect? Might bump things up.

Did your sister know he was driving with the kid while impaired? Caould cause her a bit of trouble...at least DSS involvement.

I looked it up. They don't normally do jail time for the first dwi, unless there are mitigating factors. But the mitigating factors listed were having a child in the car, or blowing more than .15 and he had both of those. This guy is such a wimp that even a couple of weekends in jail might change his attitude.

No, my sister didn't know, and I don't think she will be in any trouble with them, although they may not allow him to keep the kid by himself.

Thank goodness he didn't get into a wreck and get the child hurt.

That said, he probably will not do anything more than 7 "days" behind bars.

My brother has had two DUI's and he got "7 days" last time. 3 weekends, and an additional saturday. It's not usually done straight.

That's awful there was a child in the car, then again whenever u drive drunk there could always be an innocent child's life at stake

Not that I in any way support drunk driving but anytime a child is put into a car that child's life is at stake. The same goes for adults.

he will lose his license for a year more than likely. it's important to know whether:

1) was the car running/were the keys in the ignition/was the car parked and off (pretty much, did it look like he was pulled over the "sleep it off")

2) was he rude/belligerent, etc...

3) did he do any roadside tests, or did he decline them

3a) if he refused, he's probably facing a license suspension right now

4) did he blow in the intoxilyzer

as far as a .19, that's pretty serious, and, as i don't know what the law in NC is personally, it will probably mean one year's revocation. not to fret, he can get a hardship license so that he may drunkenly travel to and from the job he seems to desparately need.

as far as the child being in the car, you have to remember they are separate offenses. if he's found guilty of a dwi, then the DA will probably try to say child endangerment (states use different terminology). if he's not convicted of a dui, then all he was doing was sleeping in the car with a kid in the backseat, which is probably akin to going into walmart and forgetting the kid. either way, the dui would ostensibly exacerbate (not mitigate, which means to lessen) whatever charges he is facing on neglecting the kid.

hope this helps. but whatever lawyer he gets should be asking these questions. btw, don't go cheap on an attorney in dwi/dui cases, they're serious offenses that can ruin job prospects and general outlook on life, resulting in, you guessed it, more drinking.

not quite the same chief....I trust me 1000000 times sober driving 400 loud mother fuging children over one sleeping child after I've downed a 12 pack..

yes technically when you wake up in the morning your life is at stake
