What everyone does not see is that the Owners want to get back to Football faster than anyone. If the Union would have won they would have had all the leverage and would have dragged this think out over a season. They get there dues no matter what but the Owners and players are the ones that lose the most money.

Good analysis

Let's take a step back and look at where we are in general.

The Brady suit is the complaint in front of Judge Nelson. The players will win. The owners know this. It will take years to decide, could be two years on the short side or many, many years on the long side. The players know this. Before filing the Brady suit, the NFLPA decertified, both to file the antitrust suit and to force the owners to not lock them out.

The entire reason we got to the point of decertification and a lockout was because both sides thought they had a winner of a legal argument in the preliminary stages. The players thought they could get the lockout enjoined, and since the league has a loser of a case they'd settle under terms favorable to the players. The owners thought they'd be able to stall both the lockout and the case long enough that the players would be forced to come back, because in the big picture the players have more urgent financial needs than the owners. The players won lots of small victories to this point - the lockout insurance case, the initial injunction, etc.

The owners have won. The players are, plainly speaking, never going to be willing to see the Brady action out to its end if it means being locked out until the end of the case. So that their suit is a winner no longer matters, barring an extraordinary event. The question now is whether the players will choose to capitulate now to just end it, or whether they'll let the owners begin to starve them out in hopes of recapturing some leverage by letting a season pass in hopes that the fans rebel against the owners, or less likely, that Brady case or NLRB complaint moves quickly enough to bring back the idea of a big player win in the underlying case. That's the decision the players have to make right now.

Just another clear example that litigation is a winner take all strategy. The players should have worked a little harder towards a negotiated settlement. Now they are going to get hit with a barrage of poo offers. I bet D. Smith feels great about right now, he convinced these fools to de-certify and they believed it was the right thing to do, they bought into his rhetoric. In the end I am willing to bet they had no idea of the consequences - they were just blindly following their leader.

At least not in theory. The players are probably wishing about right now that he didn't represent them in the past either. His headlong dive into the court system is what got them into this mess. If he wins he comes out smelling like a rose. But now that it appears he will lose, he is smelling like a turd on hot pavement in the middle of July.

I know that this stay technically has nothing to do with the merits of the case but the case was only filed as part of the de-certification strategy, i.e. as nothing more than a leverage maneuver to get the owners to make big concessions in negotiation. Now the owners have no reason to concede much of anything and the players will be fighting for scraps. The owners could survive a season without football but I don't think your average 22 year old NFL player who has no idea how to manage money could survive.
