Just because two lower court federal judges sided with the players up to this point means absolutely nothing in regards to who's in the right.

They won't overturn it because they don't have the legal grounds to do so. The judge didn't exceed her authority in her ruling and that's all that matters.

No, the standard for overturning or even remanding the case back down Judge Nelson with instructions is if she "abused her discretion," which she did not, or whether she incorrectly applied the law, which she did. I would be very surprised to see the 8th Circuit not overturn the ruling based on precedent and law.
