Thank you I appreciate a little sympathy on your part.... I ask a question and get run off. At least im still trying to clarify were I apparently made a mistake. Based on Fiz's last comment I do not see how I was wrong.

FYI - Some poster on here just talk on do not know what they are talking about... Others have strong opinions that are based off of knowledge... Fiz is not one you want to debate with if you are unsure about what you are talking about....

Also he has no sympathy so expecting him to come at you in a nice friendly way is setting yourself up for failure.

But stay around, the huddle will value your contributions even if it does not seem like it at first.

So apparently the chaos thats about to begin if the players counsel accepts terms of the 2010 CBA will not affect the draft (barring it being rescheduled) due to the time frame it will take for this to happen.

But if a 2010 CBA is agreed upon by the players counsel, wouldnt that still go back to my original comment of there being no rookie pay ceiling....

I guess the real question would be if the players counsel agrees to the previous CBA, is that a permanent CBA for this season??? or will the owners be able to change this if they were to win their appeal and also prove the union used their right to decertify as a negotiating chip and show they truly never planned to negotiate fairly....

I dont expect sympathy from anyone!! I expect when someone tells me they hope I never post here again, that they at least confront me about my conversation. When you simply say "hopefully your last" with no explanation as to anything or my comment shows ignorance and egotism.

This is a discussion board, I made a comment that he chose to ignore completely and put an ignorant remark. I love debating and if im incorrect I learn from it. Just debate back dont be a di.....

do i really have to explain how legal precedent work? the common american notion of what an appeal is is completely ludicrous. the nfl owners, to be granted an appeal to a higher court, have to prove that something wasn't right with their original trial. they can't just give them double birds, grab their junk, and go to new jersey. they're going to try mind you but they probably won't succeed.

every single thing this judge said i've been saying for months. it's clear as day to anyone with two brain cells to rub together who bothered to read the legal history of this case. the nfl might get an emergency stay if they can prove hardship (with the draft approaching and no one wanting the trading bloodbath that would occur if between now and thursday teams could use players) and i don't even necessarily disagree with that but it's a long way from winning an appeal.

and even until that appeal is granted the nfl is going on business as usual, until they get that emergency stay, and even then it's impossible to know how long it will be for.

basically if you want closure this is the best thing for it.

in lieu of existing laws/rules to judge work guidelines, in every single contract/labor dispute the judge/arbitrator will work out a status quo clause. since the PU doesn't legally exist anymore, the judge will recommend that they just use last years rules.

it's fairly common.

Welcome, here's some free advice: Ignore anything Fiz says or don't take it seriously.

That will make you stay here a lot more palatable.

well no, I've never gone thrown a mediation nor do I know how. I have interned at law firms and I did get in to law school and I have in fact sat in on a deposition, for some car dealership in charlotte which was boring as heck

LOL Dude this not going to end up in the Supreme court what so every. This is no where near Supreme Court worthy. This will stay in the lower courts. If the NFL and NFLPA thought this would go anywhere near the Supreme Court then they would already agreed on a CBA by now. Besides Supreme Court wouldn't waste their time with something like this They have bigger fish to fry. If it had to go that far then there would be no NFL football for a few year. It would take a few years just to get that far. Bottomline there will be a new CBA soon enough or the ruling will stand through this season.:piggy:

Gotta love this site. I am an attorney and someone that has never probably seen the inside of a courtroom is attempting to correct me. Actually, the Supreme Court decided a case involving the NFL last year. Businesses that are held to the Sherman Act are looked at differently and taken very seriously.

first time poster but have been following for years! Just to clarify, if the stay is not put in place and the season falls back under the previous CBA agreement would that officially make Andrew Luck the biggest dumba$$ in college right now?

Previous CBA = No rookie salary cap......

Or he could be a genius. He talked to Peyton Manning before making his decision. Peyton could of told him that they were definitely decertifying and going to court where their lawyers would push that the draft is illegal. 2012 comes along and he has his choice of where he wants to go and for whatever money he wants. :D

For the record I don't believe this. The players maybe using it as leverage but they could not possible want to end the draft. Although with them thinking they are slaves and having to go where ever they are told to go might say otherwise. :banghead:
