Judge Nelson to rule in couple weeks

Recommended Posts

according to what i was watching on nfl network it doesn't require recertifying as it would be in a federal court setting away from all the jargon and was meant just to get this settled now rather then later..the judge was adamant about that.

Legally that's correct... but the NFL Owners won't come back to the table with the players as long as they are decertified.

I say the Judge just needs to flat order them into negotiations with her residing and get it done. She needs to sit the lawyers on the damn benches and pull the owners and the player reps into negotiations and get it over with

Refresh my memory, did they say that or did they say they refuse to negotiate with the Lawyers involved in the anti trust suit. I thought it was D Smith saying that is who the NFL had to negotiate with, that the NFLPA wouldn't do it.

the analogy the legal analyst was saying is that the judge is suggesting the kids eat their vegetables(mediate), and after the count of three you better have eaten your vegetables or your might have to eat one you don't like.

they were urged to get back to mediation..I kind of think that will become a demand at some point. they may have all this legal speak outside the court about what they are doing but in the federal court they know who's in charge.

Here's the official NFL.com article on it:

http://www.nfl.com/news/story/09000d5d81f15b06/article/nfl-refuses-to-meet-with-nflpa-lawyers-ahead-of-hearing

"We are not interested in discussing a litigation settlement," league spokesman Greg Aiello said Monday. "We are prepared to continue negotiations immediately over the terms of a new collective bargaining agreement and communicated that to the NFLPA two weeks ago."

At issue with these meetings is the pending unfair labor practices charge that the NFL filed with the National Labor Relations Board. The NFL charges that the NFLPA's decertification is a "sham" and that the former union wasn't bargaining in good faith at the time of the filing in February.

In essence, the players made the bed they are going to have to lie in.

Also of note... if you Google "NFL Owners refuse to negotiate" a post from Salty on this forum regarding a tweet surrounding this topic is the second result. Who knew the power of The Huddle?

Both sides have a case and the judge did the right thing. Both sides will have to negotiate and D.Smiths hands are tied. If the NLRB rules in favor of the owners(and they will) the Union will be forced to the table and Brady Vs. NFL will be dead in the water.

I don't see it. I agree if you go on fact and law then they should but these assclowns rule for unions 99% of the time, I don't expect any different.

Oh I hope they have to lie in the bed and the owners piss on it.

True but do you want to be the judge who lets unions break apart and cause a poo storm of epic proportions? Remember this is bigger than just the NFL.

That depends on the judge (judges? not familiar with the way the NLRB works) lean politically. If it's a more conservative board, then expect them to rule for the owners, if it's more liberal, then expect them to rule for the union.
