Is there a cap until 2010 is declared uncapped?

If we tag Peppers for the 10/11 season then it goes against the cap in that year. As there will be no cap next year no problem. The only reason the to season overlap in this way is that otherwise player contracts would be up before teams could tag them. So teams have the last part of the season to tag players for next season.

If you cut a player he will count against you in the year you cut him. Therefore you have to have room under this years cap to cut Porter. Miami had not that kind of room.

If tag contracts should fit under this years cap we then had to fit it under the same cap twice and teams would never tag players.

The more I think about it more I think you are correct P55. Peppers contract under last year's tag ended a week or so ago so they only own his rights until March 5. If they were to tag him now and he sign then that contract would take effect immediately and thus it would effect whatever year you are in. Since the new year doesn't begin until March 5 and the last day to tag a player is March 3 there is no way they would tag Peppers and it be approved by the league, without cutting some other salaries first because the other expiring contracts are good through March 4.

I think you picked up on something here that could be very insightful.
