Work place drug test question

No your friend does not have legal grounds to avoid a drug test lol

But the company paying them DOES have legal grounds to know whether they’re employing someone using illegal drugs, and rightfully so. Drug usage is a liability any way you look at it whether you agree with it or not.

Do you mean this as a right to know while on the clock or in general?

While on the clock, but there is no way to distinguish that with any form of drug testing. I also believe companies can hire and fire whoever they want, so at some point they’re going to have to rely on their ability to hire an individual rather than laws like drug testing to ‘guide’ them in finding an appropriate candidate.

But you have to remember a person is associated with the company 24-7 so the company may lose clients if they employee decides to smoke crack and do something stupid or get busted by the police. Or for the simple fact the company has to rehire  people, be down employees etc. even though none of this would be ‘on the clock’. These are liabilities even ones that aren’t obvious on the clock, while working ones. Should the company eat these costs? Or should they demand to test employees for their drug usage? I believe companies should be able to do whatever the hell they want...don’t work for them if you don’t like it.

For the record I think traditional drug testing (urine, saliva) is a joke. The most harmful drugs on this planet stay in your system the shortest amount of time. Quitting crack for three days is not more important than hiring a stoner. Also many important jobs don’t drug screen altogether. I feel I have a right to know if my doctor had a 3  year addiction to coke. 

Implementation of drug screening and employment while very necessary, has never been done correctly, it’s a joke.

This a lot of times true.    The fact is, most companies realize these tests are worthless.    The only thing that stays in longer than a couple days is weed and, big deal.    It's not worth the money invested to have them done to thousands of employees.     The best tests cost a good bit as well.     I could see a company that is smaller doing it for insurance reasons maybe, but big ones it's not as big of a deal.

Anyway, if they never signed anything, I would guess they are given a "test or fire" choice, depending on which state.    Unless they started work there like 30 years ago I have a hard time believing they didn't agree to tests when signing for the job, as even if a company doesn't do it they want to have the choice if they want.   My company (albeit a very large one) doesn't test but you have to agree to the fact that they can if they want to.

And right to work doesn't mean companies have a 100% all encompassing reason to fire someone.    There are still tons of cases being made against wrongful termination in states that support this.

Zaximus is right on the money with this one. The reality is that drug tests might as well just be marijuana tests since all other drugs are undectable in urine after three days. Even marijuana can be undetected if the test is cheap enough, just pound water for three days straight and take 4x the B12 vitamins to give your urine color so it doesn't look completely clear

However....there is the possibility of a hair test which is equally expensive as it is draconic. It tests all drugs up to 6 months. The only way to pass one of these is to damage your hair with vinegar, sun exposure, and some head shop shampoo.

Pretty much was confirmed today that everyone will be tested next week.  Completely dumb move for servers and kitchen staff - I see no reason why pot use off the job should make someone ineligible for continued employment.  This will be one of the dumbest moves this company could make.  They already have a hell of a time finding decent workers and my friend is tops in her field - never missed a day in over 10 years with this company.  Ridiculous

If you look deeply, this is probably a way to weed out the staff and save face at the same time.    Typical thing companies do now to cut cost.

    • I went on a solo elk hunt in the Flat Tops. It was awesomely miserable. LOL It was a late season hunt, I think third season and it was forecasted to snap off cold with highs in the upper thirties and lows in the single digits. fug it, I'm going anyway. They were wrong. The highs were in the low 20s and the lows were in the negative teens. I shivered so hard the first night I thought my teeth were going to break. It was the only time I've ever been legit concerned that I might be in trouble. Crawled out of my sleeping bag and got a fire started and suffered through the night bundled up next to the fire. I slept the next two nights literally wearing every stitch of clothing I'd brought with Nalgenes full of near boiling water in the bottom of my sleeping bag. That was the only way to have non-frozen water in the morning anyway. There was about a foot of snow on the ground and the melt/freeze crust was almost enough to support your weight but you'd go crashing through just as you went or make your step. It was exhausting travel and every step sounded like a rifle shot. Hunting was basically impossible. I never saw an elk in those four days, only saw 5-6 deer. LOL It was brutal but I loved it. Absolutely beautiful country that is never been to before and haven't been back since. I needed that four day complete break from society fighting for my life against the elements. I'm weird like that.
    • The lack of production is especially surprising given how much effort the team put into coaxing the best from him.  In just six short years he’s had the opportunity to work with 3 different GMs, 7 different head coaches and 10 different starting quarterbacks.  There’s literally no excuse to be made that one of those combos didn’t work.  It might be time to look withIAN.
    • I would say maybe 8 in a tier by themselves and all but 2 where picked in the top of the first allen pat m stroud burrow jackson hurts (maybe) Herbert Stafford
