i guess i should've said cognitively or culturally. and i agree, but i think the minor cognitive asymmetries in childhood development are far, far outweighed by the disparity in cultural asymmetries we assign them.

and since when is emotional reaction to sex the metric by which we weigh the morality of the act? isn't it comprehensive maturity involved in making the decision? if not how do you possibly measure something so subjective and make legal judgements based on it?

When I was a junior I knew this guy a year ahead of me who was hitting the typing teacher, man she was hot. All of us were insanely jealous and would have jumped at the chance. But no one ratted her or him out. He did look older than 17-18 though, and had his act together. I think she left teaching not long after but I don't think it was because she was discovered.

you can't

My point was that our biology plays a role cultural developments.  And not just over the last few years, but throughout history.
