I remember this guy when I was a kid who was one of my friends' "uncle" though I doubt he was blood, who was drunk as hell and was bragging to everybody about how he could light a firecracker and squeeze it in his hand so it wouldn't go off. HIPAA doesn't provide a private cause of action, regardless.  So, whether ESPN is a healthcare provider is irrelevant.  JPP would have to sue the hospital and its employee, and ESPN and its employee under state law.

He should.  It is a pretty despicable act if you ask me.  They could have reported the scoop  without putting his private medical records online and on tv.

Thre is also something fundamentally wrong with trying to get his medical records in the first place.  Media has no shame.
