Assault and communicating threats.

Do you know what kind of assault by chance Fiz? I only ask because assault is a very general charge in that it can very from actual physical violence to being verbally menacing to where someone thinks you will be violent against them.

It certainly wasn't a fuging haymaker to the temple in an elevator though IIRC.

And if it makes any of you people who are more concerned with Hardy playing than the girl he assaulted, due process technically hasn't been played out. Hardy did all this planning to request a jury trial if the judge didn't rule in his favor to drag out the legal proceedings. The team is obviously not going to do anything about it.

 

goodell looks really really bad right now and there are whispers he's going to have to fall on his sword for all this. the last thing he needs is the NFLPA blowing up at him for not letting the court case play out before suspending hardy.

Again if the victim is willing to help the defense team instead of letting the video do all the talking. Specially in a jury trial a prosecutor has a low chance to win the case. So they take what they can get.

I respectfully disagree. Your point is valid if it was a he said, she said type case, and the defendant gets cold feet, that's hard to prosecute.

If the DA pushed forward with the video, it would have been a slam dunk conviction in a judge or jury trial with or without the accusers cooperation.

I'm curious as to how much explaining away the victim can actually do to convince a jury she deserved to be KOd in an elevator. This isn't as difficult as you are attempting to make it.

Let's see "

1. I attack him before we were on camera.

2. I spit on him 30x before he hit me.

3. I threaten to shoot him once I got to the room.

4. I was drunk and it was more of me falling against the rail that knock me out. More then Ray hitting me.

Assaulting a female which is a class 1 misdemeanor in north carolina and caries with it a sentence no greater than 60 days in jail.

Just like the 7 police officers in LA caught on tape beating a motorist for 5 to 7 minutes. That was a slam dunk case as well?? Right? ?

Like I said if your best witness is committed to destroy your evidence (video, Tape recording or whatever) it hurts a prosecutor case.

I'm sorry but you are complicating life.  Didn't you know everything is black and white.  

 

Most people go through life not thinking for themselves ever. How many times have I heard in the last 24 hours "I grew up being taught you never hit a girl." Well I guess that settles it. Since you were raised that way it makes it 100% right all the time. 

 

Personally, I think hitting anyone man or woman is typically not a good idea, though I can imagine scenarios where it's necessary. 

 

I'm curious to know why people think Ray Rice punching his finance after she spit on him and hit at him is so much worst than Steve Smith punching a teammate in the film room.

You might not. But a jury of 12 people seeing the actual victim pleading and crying that the tape really doesn't tell what truly happen and begging not to punish Ray might fool a few people. As a prosecutor you have to know this.

the ray rice case kinda proves to me that hardy is innocent. when an NFL athlete attacks a women, just one hit is gonna leave her unconscious. this chick claimed hardy beat the crap out of her and she has minor bruises on her arms (much more consistent with being restrained, not attacked), yeah OK. her entire story seemed unbelievable

 

You have got to be kidding me ... unless the woman is knocked out cold, she wasn't abused? Seriously?

So you can pick up on the subtle differences that exist in situations and acknowledge them, but not the differences between men and women?
