If you're talking about my earlier posts then yes it was, I just felt like I had to dumb my responses down a bit for you.

your entire argument till now was solely based on conjecture, no facts at all, zip, zero, nada. I have just made comments related to video evidence and official reports to now. I am a neutral party, honestly if it were not for me being bored today because my beach trip got rained out I wouldnt give two flying fugs about this because as I've stated before I don't even like nascar, and am only interested because it is a big story.

4Corners, we're not having a argument, this isn't something you're winning, you have lost since you're first post. and have done nothing more then bring your own ignorance to light.

In my professional opinion it would appear that it was either intentional or he couldn't see him.

Unless I'm missing something prior to incident, Stewarts car rubs other car causing it to spin out, guy that got spun out was mad and runs out on track to confront a speeding car. Where would be the motivation for Stewart. The rub that spun out the other car was so light, Stewart may not even have realized he even spun the other guy out.

I just don't see anything that happened in that incident that would even have Stewart angry, much less rage so bad he was willing to drive over someone purposely with a car. I mean was he supposedly so mad a guy was pointing and yelling, he would purposely run him over, otherwise it makes zero sense to have been on purpose.

If Luke Kuechly takes off a guys helmet and hits him with it, and then the guy dies, that is murder. It doesn't matter if it happens at Bank of America or in a dark alley. I'm surprised so many people are either (1. Defending Tony Stewart, or (2 outright blaming the victim. Yes, its stupid to walk out on a race track but several drivers, including Tony Steward have done it. The video doesn't show the moment of impact but it is clear that TS swerved his car after the fact, and I'm not sure why.

But yes, he is rich and famous so I doubt he spends a night in jail. He'll probably retire a hero, find Jesus and get a job on ESPN.

I'm not one of these huge NASCAR fans but what are you expecting from a message board filled with fans of a NC based team talking about a sport that originated in western NC?

It's okay to glorify football violence that ruins lives but violence in NASCAR should not be supported? Do you not see the fallacy in that argument? In football the object of the game is to bring down an opponent via tackles and hits. In NASCAR the wrecks are simply byproducts of trying to overtake opponents and on the rare occasion they are started on purpose, the drivers are disciplined.

This comparison is not even in the same ballpark.

Well, no. The objective in football is to get the ball across the goalline. Tackling and whatnot is the byproduct. Also the players aren't moving at 200 miles per hour.

Probably manslaughter actually. Either way you have to prove intent which would not be hard in the scenario you dreamed up.

Proving intent and the complication of assumption of risk will make it very difficult to press charges on Stewart but I'm not a lawyer.

People have been convicted of murder on less in the Luke scenario. A football helmet blow to the head is more than enough to kill a human being.

Also in the video he clearly gunned the engine. I don't think he meant to hit him, but he did. It was a foolish act on both of their parts, but I'll be shocked if he isn't at least charged with involuntary manslaughter. Being convicted is another story.

There is a Law and Order Episode on this. Two idiot kids were having a wrestling match and then one of them died. I think in the end it turned out that the other kid killed him on purpose.

Maybe pitchers will think twice before throwing a ball traveling at 100 MPH at somebodies head.

Again not murder. There has to be a clear intent to kill usually premeditated but not always. There will never ever be a murder charge.

I'll bet you a weeks worth of avatar choice that he doesn't get charged with manslaughter.
