Seems like a lot of people are getting the legal terminology confused here:

 

Assault - An intentional act by one person that creates an apprehension in another of an imminent harmful or offensive contact. E.g.: Threatening to punch someone, pointing a gun at them, etc.

 

Battery - An intentional unpermitted act causing harmful or offensive contact with the "person" of another. E.g.: Actually making contact with a punch, lacerations with a weapon, etc.

 

 

In layman's terms, vehemently screaming and threatening to kick someone's ass is assault. Actually doing so is battery, and trapping someone in a situation where they feel that they can't escape while committing assault is grounds for self-defense, regardless of whether or not battery actually took place. Physically restraining someone against their will is considered unlawful detainment, removing them from said place against their will - kidnapping.

 

 

Since Hardy was convicted of assault, this means the judge felt he was guilty of being a threatening presence to Holder. No more, no less, and I suspect this was mainly due to the physical size difference only. It doesn't help this incident took place in the "bible belt," as there is a larger emphasis on "woman victim" pleas than other parts of the nation. We tend to be gender-biased here in the South in male v. female cases, as evidenced by a lot of mother's rights decisions and assumption of male guilt before evidence is presented.

 

Personally, I think Hardy got convicted on what appears to be flimsy evidence. I'm not one to immediately believe the football player is innocent just because he plays for my team either. I do believe that all people are innocent until proven guilty, however. Hardy is doing what he needs to do in this situation, by appealing for a higher court trial. It will force a reexamination of the evidence, plus give him public support and a jury he can potentially sway to his side. I wish him luck, provided that he didn't do the deed.

But the reality is that he isn't signed for next year hasn't agreed to a long term contract and I have heard rumors that gettleman had concerns about his emotional maturity before any of this.  So to assume he is likely gone is hardly a leap when it is likely that either Hardy or Johnson was going to be gone anyway.  This just helps tip the scale more toward Hardy being gone.

 

Exactly.  We knew that after this season, we would not be able to afford both Hardy and Johnson.  We drafted an insurance policy with Ealy with that in mind.  Then Hardy gets in trouble and makes the decision easy for the Panthers.  The combination of the high salary he will demand and his trouble with the law (not to mention a probable multi-game suspension to start the 2015 season) make this a pretty easy choice.  Someone will pay him really big money this off season, but it won't be us.  I think it has more to do with a business decision than it is a morality decision.

Yea I don't doubt for a second that there was some sort of physical contact between her and someone there. If that's all it takes then I guess he's guilty. But it certainly doesn't sound like he did anything to hurt her or was overly aggressive or too rough. Sounds like she was hysterical (they haven't seen crazy yet, coked up, etc) and those present we're trying to remove a problem. From what information we've been privy to, it doesn't sound like he did anything wrong other than associate himself with a psycho (which isn't a criminal offense). From the sound of it, even (hypothetically) if no one there touched her at all if she hit someone and bruised her hand on them then she was "assaulted". No win situation and she knew it and manipulated everything because she was getting cut off and wanted her payday. Hopefully the details are taken into consideration by the organization and it's no just viewed as "he was found guilty of something by a bottom tier court, and it involved a woman, so he gotsta go". Not holding my breath on that though. I think it's a 50/50.

 

You're assuming based on one side of the testimony and throwing the other side completely out. The fact is only two people know what happened, and neither are telling the total truth. Don't let being a fan cloud your judgement like that. Nobody knows poo.

I'm not letting fanhood cloud anything not throwing out one side. I'm taking both into consideration and believing that it's more likely, based on known facts (she was coked up, comments like what her friend described) that hardy's story is closer to the truth than hers. Do I believe he probably said things he shouldn't have, apparently constituting "assault"? Yea. Do I believe he choked her out, slammed her against the wall, etc? Not for a moment.

I do believe he should counter sue for slander, defamation and assault because you can pretty much guarantee she said as much "assault" worthy stuff too.

Delete your account if you can't handle debate and opinions other then your own..obviously you have not been around out of control drunk indivuals and the level of stupidity and violence that can occur. If you think the organization isn't concerned about the drugs then you are definitely blind in one eye and can't see out the other.I am not bias against Hardy,but I am a Carolina Panther fan.Any ONE PLAYER who causes problems,gets arrested or suspended is causing a negative impact on the team.

Complete misinformation? Everything I said are statements that where stated in court, not something I pulled out of thin air.

1. Was there drugs and booze involved? Yes

2. Was there an altercation between a male and a female that let to an arrest of one of their players? Yes

3. Will the Panthers be concerned about all the above? Yes

4. Did Hardy have "character issues" before he was drafted that helped drop his draft stock? Yes

5.Will his money demands and this conviction effect a contract next year? Yes

Not one statement of misinformation has been stated above, The rest is my opinion and it matters not to me if you accept it or not.

I have hope for this situation because like a lot of people I have a hard time imaging a jury unanimously agreeing to find Hardy guilty based on the testimony of a scorned ex-girlfriend who admitted she was under the influence of both drugs and alcohol when these events occurred combined with the testimony of a women would admittedly never saw any of these events but is apparently equipped with some sort of sonar that enables her to decipher exactly what it sounds like when a man slams a women against a wall and drags her across the floor.  

 

Do I believe Hardy is totally innocent - no, but I also don't believe his guilty of anything close to what he's been accused of.

One more thing, I like Hardy and he is a very good player and will be missed on the field. Do I think he beat her up her like she stated and body slammed her/strangled her.....no.I think he probably did threaten her and maybe toss her around a bit.....and she probably got in his face and was swinging at him while all coked up and drunk. A suspension that may be forthcoming (along with F.A. and his stupid ass),will really put this team behind the eight ball to start the season. He did a very immature and stupid thing that probably tainted him in the eyes of management long term. The Panthers needed a fast start and this will hurt the team.My loyalty is to the team and not any specific player......stupid immature crap that has ripple effects for the entire squad is what pisses me off.

Well judgement is in..now convicted and a felon (pending appeal). Truthfully, he took the Kraken moniker and ran with it(maybe way to seriously).He planned to market it and cash in.Being involved with drugs violence,and crazy people has just killed that.Can he recover from this...to a degree perhaps..but it won't be here in Carolina.When he was drafted,one knock on him was the "character issue" concerns.They have now reared their ugly head.Its been fun Greg, but the black and blue is not in your future.C.J. just became much more important to this franchise.

Fail. So much goddamn fail. Facepalm.gif.
