They may try to say it was 50/50 fault so you both have to pay deductible.  Eases they burden on them for both cars. 

If you have the same company, deductibles are usually waived for both parties in this case. 95+ % of rear end collisions, the driver in the rear is at fault. Other driver is definitely on the hook for med expenses( up to a limit)
