I'm not a lawer so I'm just speculating but.....

she was subpoenaed.  I'm assuming she would then be charged with a failure to appear or contempt of court.  Hardy case would likely be thrown out with her testimony being the only source of evidence.

at this rate, neither...  I might lean towards pulling out the good stuff in celebration of THOTs who get lost on the way to the courthouse..  twice.
