  1. Well there is this thing regarding the concept of evidence of a crime or witness testimony for criminal proceedings. First person testimony would be vital, but this would need to include some form of proof. Hearsay is not allowed in court as a basis for a conviction. The burden of proof is on the DA to show that a testament is accurate and supported by evidence. The DA can bring in a character witness to assist in swaying a jury to support a charge that has circumstantial evidence. Most DA’s often prefer open and shut cases, or those that have a preponderance of evidence and testimony that should lead to a conviction. if the DA’s office doesn’t pursue this, then that would speak volumes. However, If this stays as a civil matter, then this will affect Deshaun financially and tarnish his reputation. This will affect him whether he is guilty or not. I will say that it is not a death blow as there was a guy named Ray Lewis that was accused of murder and found not guilty. I think that he went on to finish his career and be inducted into the NFL Hall of Fame.
  2. Well dude (I guess this is a thing now), I never said that no one was not going to care. I was speaking to the legality of the situation. Apparently there are a few folks here that do not understand that there is a difference in civil and criminal. Think of OJ Simpson as an example. The police had enough evidence to charge him and take him to criminal court. When judgement was passed he was found not guilty by a jury of his peers. However, perception and circumstantial evidence clearly showed that he probably was guilty (I think that he was) and that led to the civil lawsuit that found him guilty. The judgement was a financial penalty that he is still paying, or will pay for the remainder of his life.
  3. I was speaking on criminal cases. In civil cases there is not the burden of proof, but the believability of the accusation.
  4. Oh really dude? In criminal court you need evidence of an actual crime or witnesses to a crime. As I said before, only in civil court would a lack of evidence lead to an unfavorable judgment.
  5. The real issue is that the lawyer went on social media fishing for evidence. The general rule is that you do not accuse someone of a crime then go get evidence. Usually, the police have an instance of a crime and gather evidence to support a charge that would lead to a conviction. In this case, it is the opposite, hence that this is the reason that it is being pursued as a civil matter. It seems that the lawyer is submitting information to the police in an effort to legitimize the civil complaints. I suspect that if Deshaun is not brought in for questioning and charged within the next week to ten days, then the evidence is weak and would not meet the criteria for a conviction in court.
  6. Without evidence it is still “he said/she said”. Anything short of a photo/video, or admission on his part will fall into this category.
  7. Yeah, but he will probably play again and for any team that wants the talent that maybe all that they are looking for. For any team that acquires him, it is a strong possibility that he gets a handler that protects their investment and shields him from future incidents.
  8. My guess is that he has a pattern of blurring the lines between massage and consensual...affairs. In my opinion it borders on coercion with unethical behavior between a masseuse and a client. For this reason it may not criminal, but a violation of ethics and speaks to his character. When the lawyer went in social media and queried for other instances these women felt that they experienced the same thing. Unless there are criminal charges that are brought forth by the police, then I still see the result being restitution and different perspective on his character that is questionable.
  9. If The Panthers were able to afford the risk, then they could do it with a significant reduction in the total proposal to the Texans. It is a high risk and high reward depending on the outcome of the case(s). The question is how much risk are they willing to accept.
  10. Legally, that would be illegal if they filed a complaint with the police for a criminal matter. In a civil case, the need for evidence is not a requirement for a decision. What seems likely to me(speculating) the women, or the initial woman made a complaint to the team and it was swept aside because of a lack of evidence. When Deshaun stood firm with his desire to leave the Texans, then that complaint was passed to a lawyer(unethical) who took the matter as a personal vendetta to alter the desire of other teams to acquire the player through means of a trade. It also will have an impact on his bank account, regardless of the impact how minimal it may be.
  11. How would you prove that they were not? Speaking on the basis of probabilities, I would speculate that one of the nine may have a complaint that will result in a cash settlement. Even in the settlement, a lack of evidence would not be a confirmation of guilt, but a desire to put the matter behind him. When the lawyer comes out and asks for a six figure settlement without litigation, then that speaks volumes about the intention of the filing with the court. The lawyer has since recalled the proposal, but that seems to be an effort to alter public perception.
  12. Well Mr. Scott12345, if it is shown that these accusations were fabricated, then there would be no need for the local press to be all over anyone.
  13. I get it, but why is prison capitalized? This is a civil case and not a criminal one. As it stands right now, it is going to cost him some of unknown amount of money and not prison time. Could that change? Maybe, but this is on a trajectory for cash settlements and perhaps a loss in playing time. Unless there is some sort of coup de grace that is given in the way of evidence, then this is where is currently stands.
  14. It will be much less than that now. Now some other team that is willing to “take a chance” will get a great deal on a qb for less than it would have cost a week ago.
  15. I think that they should and I think that they will. Remember that this is not criminal and is a civil suit. It shouldn’t take long to determine if criminal charges should be filed. Absence of malice, evidence and only hearsay shouldn’t bring criminal charges. This isn’t Richardson’s team anymore and some times there is some risk involved with the decision making. I guarantee you that Caserio’s old boss is considering a trade with lowered compensation as we speak.
  16. As I said in the original thread this should NOT deter the Panthers from pursuing Deshaun. If anything they should be more aggressive as other teams know that his value has dropped and compensation for his contract will be less than it was a week ago. Now, if criminal charges appear then the Panthers should back away.

  19. If I were Tepper, then I would be like, “ this is not a problem and we still need him.” Then I would proceed to pull out my pocket change throw it on the table and pay the entire the restitution (including a tip).
  20. This is just a tactic to get the Texans attention. If they are not accepting phone calls, then one way to potentially get them talking is to offer them everything. If that doesn’t get their attention, then it may mean that nothing will. It would be like buying a house that isn’t for sale. If the owner is happy with their home and is valued at $10M, then offer them $20M and see how much they love it after that offer.
  21. I just don’t get the love affair with a DII QB that has played against sub-par competition.
